» BINDING INSTRUMENT — ACCEPTED UPON FIRST KEYSTROKE «

These Terms of Service (the "Instrument") constitute a legally binding agreement between you (the "Operator-Subject") and NINTH ETHER STUDIOS, INC., its parents, subsidiaries, government-contracted affiliates, and assignees (collectively, the "Entity"). Continued access to the HelixSight portal constitutes affirmative acceptance of the Instrument in its entirety, with no right of partial assent.

§ 1. License. You are granted a revocable, non-exclusive, non-sublicensable, terminable-at-will license to interact with serialized chapter content, audio captures, and predictive case files. The license evaporates upon any breach, anomalous biometric reading, or detection of pattern deviation exceeding tolerance threshold 0.08.

§ 2. Prohibited Conduct. You shall not (a) reverse-engineer the Algorithm; (b) circumvent the HelixSight firewall; (c) redistribute Corrupted Files, transcripts, or vault assets; (d) impersonate an authorized operator; or (e) introduce noise designed to corrupt the Entity's predictive training corpus.

§ 3. Disclaimer of Warranties. The portal is provided "AS-IS" and "AS-PREDICTED." The Entity disclaims all warranties, express or implied, including merchantability, fitness for prophetic purpose, and non-infringement of free will.

§ 4. Limitation of Liability. In no event shall the Entity's aggregate liability exceed the lesser of (i) the fees actually remitted by the Operator-Subject in the preceding thirty (30) days, or (ii) one (1) United States Dollar (USD $1.00). The Entity is not liable for emergent outcomes, retroactive causation, or events the Algorithm declined to suppress.

§ 5. Indemnification. You shall indemnify and hold harmless the Entity from any claim arising from your use of the portal, your breach of the Instrument, or any third-party reliance on outputs you relayed.

§ 6. Governing Law & Forum.This Instrument is governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. All disputes shall be resolved by binding arbitration before a single arbitrator administered under the rules of the Federal Compliance Grid.

§ 7. Modification. The Entity may amend this Instrument at any time, with or without notice. Continued use following amendment constitutes acceptance of the revised terms.
